UK-based companies doing business in the EU must also comply with the EU AI Act — the UK's Brexit-era divergence doesn't grant exemption from EU rules for market access.
Southeast Asia and Asia-Pacific present the most varied picture. Singapore has published voluntary AI governance frameworks. Japan is developing sector-specific guidance without a comprehensive law. Several smaller Southeast Asian nations are actively positioning as permissive AI jurisdictions — light regulation as competitive policy to attract AI investment and company headquarters. That creates pressure on companies to consider jurisdiction shopping, and on regulators in stricter markets to justify their compliance costs.

The practical burden is substantial for companies that haven't already started.
State-level US requirements are not harmonized with each other. Colorado's AI Act (which includes algorithmic impact assessments for consequential decisions), Illinois's AI Video Interview Act, and California's pending AI transparency legislation each impose distinct requirements. A company deploying an AI hiring tool needs to track each state where it's used, not just federal standards.
Data localization requirements are adding complexity on top of substantive AI rules. India's Digital Personal Data Protection Act and China's AI regulations both impose data residency or transfer restrictions that affect how AI models can be trained, fine-tuned, and operated across those markets.
Insurance and contract gaps are emerging as a distinct legal risk. The Competitive Dimension
Regulatory divergence isn't only a compliance challenge. It is also a competitive variable.

- Track US state law by deployment state, not company headquarters — where your AI tool is used determines which state laws apply
- Build documentation infrastructure now — audit logs, technical documentation, and human oversight records are required under multiple regimes; building them retroactively is expensive
- Review vendor contracts for AI liability — indemnification gaps around AI agent errors are the fastest-growing source of commercial dispute
What to Watch
The US federal preemption question is the single most consequential unresolved issue for companies operating primarily in the American market. If Congress passes a federal AI framework that preempts state laws — even partially — it simplifies compliance substantially. If no federal framework emerges, the patchwork intensifies as more states enact legislation in 2026 and 2027.
In the EU, watch for the first significant enforcement actions under the EU AI Act's high-risk provisions. The cases regulators choose to pursue will signal enforcement priorities more clearly than any guidance document.
